Resisting Arrest—DismissalGerald Bourque represented the wife of a Harris County Deputy who had been charged with Resisting Arrest.
The incident occurred at a Club in The Woodlands when one of the off-duty Officers asked the Defendant to put her drink down because the Bar was closing. The Officer claimed that the Defendant refused to comply with his order and when he attempted to arrest her, she resisted. The Defendant was actually tasered by the off-duty Officer.
We interviewed a number of witnesses who disputed the Officer's version of events. Gerald was able to use the witness statements to get the District Attorney to dismiss the charges.
Capital Murder—Acquittal
Mack Arnold represented an unsavory character charged with murder. Our investigation revealed that the State's case was based on some very unreliable witnesses, without any credibility.
Mack did a great job getting this point across to the Jury who found the Defendant not guilty.
Everybody on our staff gives their best regards to Mack who is at home recuperating from a recent illness. Our prayers to Mack for a speedy recovery. I know a lot of Mack's clients wanted to visit him but they can't make bond.
Capital Murder Trial/Favorable Outcome
Gary Polland's juvenile client, who was not certified as an adult, stood trial in November 2007 for his "role in the incident".
Our investigation revealed that the State's cooperating witness was less than truthful about the Defendant's participation in the shooting. Our investigation also developed information that led the Jury to believe that the Defendant had no idea that his brother was going to commit a robbery/murder. In the middle of the trial the State offered the Defendant a five year plea which he accepted.
Ineffective Council Victory
One of our clients represented a school teacher who was charged with having sex with two of his High School students. We conducted our usual thorough investigation on behalf of our client, the Defense Attorney. We were able to find some students who would testify that the Complainants were not credible but we did also find cell phone history which was very damaging between the Defendant and the Complainants. We also identified a potential third Complainant who had not spoken to authorities. The Defendant agreed to a six year sentence but soon after the deal was cut, the Defendant's parents hired a Law Firm to seek a new trial on the grounds that our client, the Defense Attorney, provided ineffective counsel. The District Attorney was provided all of our work product by the Defendant's new Attorney. A real role reversal for us, Vice President, Carey Wellmaker, spent three days working with the District Attorney's office reviewing our work product and listening to testimony. After hearing all the evidence, the Judge ruled against granting a new trial because there was no evidence that the Defense Attorney was not effective. Both the Assistant District Attorney and our client said that the detailed work product that we provided "saved the day". Hooray for the "good guys!"
Adult Certification—Victory
Gary Polland represented a juvenile who was charged with Capital Murder, along with his adult brother. The State was trying to certify Gary's client so he could stand trial as an adult. Gary did a masterful job utilizing the background information we had compiled on the Defendant's lack of past problems and also proved to the Court the juvenile was not the shooter, preventing the State from winning certification.
