The Strangulation Investigation

Colin Amann represented a young man who had been charged by his live-in girlfriend with choking her one night at her residence. The defendant denied committing the assault, but did admit to breaking the girlfriend’s car window during the altercation that occurred.

Our background investigation on our complainant indicated that she had a long history of drug abuse and was currently on probation for possession. We obtained the police calls for service at 3 of the residences where the complainant had previously lived. One of the calls for service involved her filing a false claim against a former boyfriend for stealing her jewelry. Along with a number of drug and alcohol disturbances we also found an incident in which she called the police, stating that people were breaking into her neighbor’s house.

The responding officer wrote in his report that the female was hallucinating and that the people she had observed breaking into the house were actually her neighbors coming home.

Investigator Jose Arreola attempted to locate and contact the complainant without any success. We did find out the complainant was living someplace in the area with a boyfriend and was believed to be pregnant.  We also determined that the complainant told her family members that she wasn’t going to show in court.

Result of Investigation: The case was dismissed by the prosecutor.
