Capital Murder: Adult Certification Thwarted
Attorney Gary Polland represented a juvenile who was charged with Capital Murder, along with his adult brother.

The State was trying to certify Gary’s client so he could stand trial as an adult. Gary did a masterful job utilizing the background information we had compiled on the Defendant’s lack of past problems, and also proved to the Court the juvenile was not the shooter; preventing the State from winning certification.

Gary Polland’s juvenile client, who was not certified as an adult, stood trial for his “role in the incident.”
Our Detectives Remained Involved
Our Investigation revealed that the State’s cooperating witness was less than truthful about the Defendants participation in the shooting. Our investigation also developed information that led the jury to believe that the Defendant had no idea that his brother was going to commit a robbery/murder. In the middle of the trial the State offered the Defendant a five year plea, which he accepted.
